Terms of Service
These Terms govern your use of MyDayBack. By creating an account or using the service, you agree to them. If you don't agree, don't use the service.
1. The service
MyDayBack is an AI customer communication platform built by MyDayBack LLC. We provide automated SMS, voice, email, and social media tools for small businesses — bookings, reminders, customer service, lead follow-up, and related capabilities.
2. Eligibility & account responsibility
You must be at least 18 years old and have the authority to bind the business you're signing up. You are responsible for:
- Keeping your login credentials secure
- Activity that happens under your account
- Ensuring your customer-facing communications comply with applicable laws (TCPA, CAN-SPAM, state-specific rules)
- Obtaining valid consent from your customers before adding their numbers to MyDayBack
3. Subscriptions & billing
- Plans: current pricing posted at mydayback.com
- Billing: monthly in advance via Stripe
- Free trial: 7 days free starting on signup. We collect a payment method at signup but do not charge it during the trial. On day 8 your card is charged the monthly rate of your selected plan unless you cancel before then.
- 30-day money-back guarantee: If at any time within 30 days of your initial signup you decide MyDayBack isn't right for you, contact us for a full refund of any amount paid. After day 30, refunds are not available but you can cancel anytime.
- Cancellation: you can cancel anytime from your dashboard. Service ends at the close of your current billing period; we don't issue prorated refunds for partial months
- Price changes: we'll give you at least 30 days' notice before changing pricing on your plan
4. Acceptable use
You may not use MyDayBack to:
- Send spam or unsolicited messages
- Send messages that are unlawful, harassing, threatening, abusive, defamatory, or fraudulent
- Send messages promoting controlled substances, firearms, gambling (where prohibited), adult content, or other restricted categories under applicable carrier rules
- Bypass STOP or other opt-out requests
- Reverse engineer, scrape, overload, or otherwise disrupt the service
- Resell the service without a written reseller or white-label agreement with us
We reserve the right to suspend accounts that violate this policy.
5. SMS-specific terms
You acknowledge that:
- You will obtain valid TCPA-compliant consent before adding any phone number to MyDayBack
- You will honor STOP and HELP requests immediately
- You will display the SMS opt-in disclosure language we provide on customer-facing materials such as opt-in cards, websites, and signage
- You are responsible for the content sent through your account
- A2P 10DLC carrier rules apply; campaigns must be registered through MyDayBack and are subject to carrier approval timelines outside our control
6. AI-generated content
MyDayBack uses third-party large language models (Anthropic, Groq) to generate responses. You acknowledge:
- AI responses can occasionally be inaccurate. You are responsible for reviewing and overseeing what your bot says to your customers
- We provide manager takeover tools — use them when AI cannot or should not handle something
- You should have a human staff member available for time-sensitive, high-stakes, or sensitive customer interactions
7. Intellectual property
- The MyDayBack platform, software, brand, and original content are owned by MyDayBack LLC
- Your business data and the content you upload remain yours. You grant MyDayBack a license to use it solely to operate the service for your account
- We may use aggregated, de-identified usage data to improve the service. This data does not identify your business or your customers
8. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We do not warrant that AI-generated responses will be accurate, complete, or appropriate in every situation.
9. Limitation of liability
To the maximum extent permitted by law, MyDayBack LLC's total liability arising out of or related to these Terms or the service will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim, or (b) one hundred US dollars ($100).
We are not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits, lost business, or lost data.
10. Termination
We may suspend or terminate your account for material breach of these Terms, non-payment, or in our reasonable judgment to protect the service or other users. You may cancel anytime under Section 3.
Upon termination, your data is retained per Section 6 of our Privacy Policy.
11. Governing law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Benton County, Arkansas, and you and MyDayBack LLC consent to the personal jurisdiction of those courts.
12. Changes
We may update these Terms. The "Effective" date at the top reflects the latest version. Material changes will be notified to active subscribers by email at least 30 days before they take effect.
